The state of Colorado grants only certain individuals the right to pursue justice for a wrongful death. The decedent’s surviving spouse is given first priority in the first year after the death. If the surviving spouse chooses, they may task their children (as long as they are also the children of the decedent) to file suit with or without them. After the first year, a beneficiary of the decedent may also file suit with any surviving children.
In the event that the decedent did not have a spouse, children, or beneficiaries, the right to file suit would go to the decedent’s parents.
All states have deadlines, or “statutes of limitations,” for the filing of a wrongful death lawsuit. In Colorado, this statute of limitations is two years from the date of the death. Under certain circumstances, the deadline may be pushed to four years from the date of the death, if the driver that caused the death committed the crimes of vehicular homicide and leaving the scene of the accident.
